Terms & Conditions: Acquisition Plans
Payment Schedule:
The total amount due for the selected artwork is outlined in the invoice.
The buyer agrees to make an initial down payment, if applicable, followed by [specify frequency, e.g., monthly] installments until the total amount is paid in full.
Late Payments:
Late payments will incur a fee of $25 per occurrence.
Failure to make consecutive payments may result in the cancellation of the payment plan and forfeiture of any prior payments.
Ownership and Delivery:
Ownership of the artwork remains with Sharp Art Studio, LLC until the full payment is received and title transfers to the buyer upon full payment.
The artwork will be delivered within 30 days after completion of the payment plan, and any associated shipping costs will be the responsibility of the buyer.
Risk of Loss:
Risk of loss during shipping shall be borne by Sharp Art Studio if the seller arranges for shipping to the buyer's designated location.
If the buyer arranges for shipping or pickup of the artwork, the risk of loss shall transfer to the buyer upon shipment or when the goods are made available for pickup.
Shipping Insurance:
The buyer agrees to pay for shipping insurance in the final installment payment.
The shipment will be insured for the total cost of the item, and the cost of shipping insurance will be included in the final installment payment.
Modification of Payment Plan:
Extension of Payment Period:
If you need more time to complete your payments, simply contact us to discuss extending the payment period, which may lower your monthly installment amounts.
Adjustment of Installment Amounts:
We understand that financial situations can change. If you need to adjust your installment amounts, we can work together to find a solution that fits your budget.
Partial Payments:
If you'd like to make partial payments outside of the agreed-upon schedule, let us know, and we can accommodate your needs as long as the total amount is paid within a reasonable timeframe.
Payment Plan Consolidation:
If you have multiple payment plans with Sharp Art Studio, LLC or owe payments on multiple items, we can consolidate your payment plans into a single, more manageable arrangement.
Temporary Suspension or Deferral:
If you're facing unexpected financial difficulties, we can temporarily suspend or defer payments for a specified period to provide temporary relief.
Renegotiation of Terms:
If significant changes occur in your circumstances or the market conditions, we're open to renegotiating the terms of your payment plan. Contact us to discuss adjusting the interest rate, extending the payment period, or modifying the payment schedule.
Fees and Penalties:
There are no penalties or fees for paying off your balance earlier than agreed. Simply contact us to inform us of your intention to pay in full.
Cancellation Policy:
The buyer may cancel the payment plan at any time by providing written notice to Sharp Art Studio LLC.
A cancellation fee of 30% of the remaining balance may apply.
Refunds and Returns:
Refunds or exchanges are not permitted once the payment plan has commenced.
However, if the artwork is found to be damaged upon receipt, the buyer may be eligible for a refund or replacement.
Debt Collection from Estate:
In the event of the buyer's death before the completion of the payment plan, any outstanding balance remaining on the artwork shall be considered a debt owed by the estate of the deceased buyer.
Sharp Art Studio, LLC reserves the right to pursue collection of this debt from the estate through legal means, including but not limited to filing a claim with the executor or administrator of the estate.
The estate shall be responsible for settling any outstanding balance in accordance with the applicable laws and regulations governing estate settlements, and any payments received from the estate towards the outstanding balance shall be credited towards the total amount owed.
Force Majeure Policy:
Definition:
Force majeure refers to unforeseeable circumstances beyond the control of the seller that prevent the fulfillment of contractual obligations.
These circumstances may include but are not limited to natural disasters, acts of war, terrorism, strikes, governmental actions, or other events beyond reasonable control.
Impact on Performance:
In the event of a force majeure event, the seller shall be excused from performance of its obligations under the contract for the duration of the force majeure event, and any deadlines or timeframes for performance shall be extended accordingly.
Communication:
The seller shall promptly notify the buyer of the occurrence of a force majeure event and its anticipated impact on the performance of the contract.
The seller shall make reasonable efforts to mitigate the effects of the force majeure event and resume performance as soon as practicable.
No Liability:
Neither party shall be liable to the other for any failure or delay in the performance of its obligations under the contract to the extent caused by a force majeure event.
However, the buyer may be entitled to a refund or alternative arrangements if performance is permanently prevented by the force majeure event.
Termination:
If the force majeure event continues for an extended period and substantially prevents performance of the contract, either party may have the right to terminate the contract upon written notice to the other party.
In such cases, any payments made by the buyer shall be refunded, and neither party shall have any further obligations under the contract.
Governing Law:
This force majeure policy shall be governed by the laws of California, and any disputes arising from or relating to this policy shall be resolved exclusively in the courts of California.
Notice:
Any notices or communications regarding force majeure events shall be provided in writing and delivered to the other party's designated contact.
Severability:
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will still be binding and enforceable to the fullest extent permitted by law.
Waiver:
Any failure or delay by either party to enforce any provision of the agreement shall not be construed as a waiver of that provision or any other provision.
Entire Agreement:
These Terms & Conditions constitute the entire agreement between the parties with respect to the subject matter and supersede all prior agreements and understandings, whether written or oral.
Amendment:
Any amendments or modifications to the agreement must be made in writing and signed by both parties to be valid.
Electronic Signatures:
The parties acknowledge that electronic signatures and communications are acceptable and legally binding for the purposes of entering into the agreement.
Privacy Policy:
Information Collection: We collect personal information, such as name, email address, mailing address, and payment details, solely for the purpose of processing orders and providing customer support.
Data Usage: Personal information provided by customers is used only to fulfill orders, communicate order updates, and respond to customer inquiries. We do not sell, trade, or otherwise transfer personally identifiable information to third parties unless required by law or for order fulfillment purposes (e.g., sharing shipping details with carriers).
Data Security: We implement reasonable security measures to protect the personal information provided by our customers against unauthorized access, alteration, disclosure, or destruction.
Payment Processing: Payment information (e.g., credit card details) is securely processed by trusted third-party payment processors. We do not store or have access to customers' payment card details.
Email Communications: With the customer's consent, we may occasionally send promotional emails about new artworks, special offers, or upcoming events. Customers have the option to opt out of receiving such communications at any time.
Cookies and Tracking: Our website may use cookies and similar tracking technologies to enhance the user experience and analyze website traffic. Customers can adjust their browser settings to refuse cookies or receive notifications when cookies are being sent. However, please note that some website features may not function properly without cookies.
